  1. Models: We may share your personal information with the models booked through TFC Agency to fulfill the contractual obligations of the booking.

Terms and conditions:

  1. Booking Models: The Fashion Composers Agency represents professional dancers as models for various fashion and creative projects. Clients can book models through The Fashion Composers for specific assignments or events, subject to availability and agreed-upon terms. All bookings are subject to written agreements between The Fashion Composers Agency and the client, outlining the details of the assignment, including but not limited to the scope of work, compensation, and usage rights.

  2. Payment and Billing: Clients agree to pay the agreed-upon fees for the services of the booked model(s) as per the terms specified in the booking agreement. Payments are due as per the agreed-upon payment schedule and can be made via the payment methods accepted by The Fashion Composers Agency. In case of cancellation or changes to the booking, clients may be subject to cancellation fees or additional charges as specified in the booking agreement.

  3. Intellectual Property: All rights, including but not limited to copyrights, trademarks, and intellectual property rights, in and to the images or materials created during the assignment with the booked model(s), shall remain with the client or their respective owners as per the applicable laws. The client shall have the right to use the images or materials only for the purpose specified in the booking agreement and shall not transfer, assign, or license such rights to any third party without prior written consent from The Fashion Composers Agency and the booked model(s).

  4. Confidentiality: The client agrees to maintain the confidentiality of any sensitive information shared by The Fashion Composers Agency, including but not limited to personal information of the models, booking rates, and any other proprietary or confidential information. The client shall not disclose, share, or use such information for any purpose other than the specific assignment for which the model(s) were booked, without prior written consent from The Fashion Composers Agency.

  5. Liability and Indemnity: The client agrees to release, indemnify, and hold harmless The Fashion Composers Agency and its affiliates, as well as the booked model(s), from any claims, damages, losses, or liabilities arising out of or in connection with the client's use of the services of the booked model(s), including but not limited to any injuries, accidents, or disputes arising during the assignment. The client is solely responsible for obtaining any necessary insurance coverage for the assignment.

  6. Termination: The Fashion Composers Agency reserves the right to terminate any booking agreement with a client if there is a breach of these Terms and Conditions or any other applicable agreements. The client also has the right to terminate the booking agreement upon written notice to The Fashion Composers Agency, subject to any applicable cancellation fees or charges as specified in the booking agreement.

  7. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands.

  8. Travel Expenses: Unless specifically agreed otherwise, the client shall be responsible for covering all travel expenses for the booked model(s), including but not limited to transportation, accommodation, and meals, for assignments both within and outside The Netherlands.

  9. Covid Testing: If Covid testing is required for an assignment, the client shall be responsible for covering the cost of such testing for the booked model(s) as per the applicable regulations and guidelines.

  10. Fees and Overtime: Fees for the services of the booked model(s) are charged on a per-day basis, with a "day" defined as no more than 10 hours and "half a day" defined as no more than 5 hours. Overtime, beyond the defined hours, will be charged at one-and-a-half times the hourly rate as agreed upon in the booking agreement.

  11. Extra Usage: If the client wishes to use the model's image or reproductions, adaptations, or drawings derived from that image, or any other representation, beyond what was specified beforehand in the booking agreement, an extra fee will be charged, which shall not be lower than the day fee.

  12. Agency's Marketing Usage: The Fashion Composers Agency reserves the right to use all images from the production for their own marketing and promotional purposes unless otherwise agreed upon in writing with the client.

  13. Model's Health and Travel Disruptions: The Fashion Composers Agency shall not be held responsible for any accidents, sickness, or travel disruptions, including but not limited to denial of entry to a working destination or travel disruptions due to Covid, that the model(s) might endure prior to the production, which may render them unable to attend the assignment.

  14. Cancellation Policy: All confirmed bookings that are cancelled with less than 3 working days' notice will be charged at the full rate. Confirmed bookings that are canceled within 5 days will be charged at 50% of the agreed-upon rate, unless otherwise specified in the booking agreement.

By booking a model through The Fashion Composers Agency, the client acknowledges and agrees to these Terms and Conditions, as well as any other applicable agreements, and agrees to comply with all the terms and requirements outlined therein.
